1. Introduction and Acceptance
These Terms of Service (“Terms”) govern your access to and use of the Senda mobile application, website, and related services (collectively, the “Services”), provided by Coupl Technologies, Inc. (“Senda,” “we,” “us,” or “our”), a Delaware corporation.
Senda partners with Saber Money Canada Inc. (“Partner”), a licensed money services business, to provide the underlying money transmission and cross-border funds transfer services. Senda is a technology platform and program manager; money transmission services are provided by, and subject to the regulatory oversight of, the Partner in the applicable jurisdictions.
By creating an account, accessing, or using the Services, you agree to be bound by these Terms and by the Partner’s terms of service for money transmission, which are incorporated by reference and available at [PARTNER TERMS URL]. If you do not agree, you must not use the Services.
2. Eligibility
To use Senda, you must:
- Be at least 18 years of age;
- Be a resident of the United States with a valid US-based bank account, debit card, or other supported funding source;
- Provide accurate, current, and complete identification information as required for identity verification (KYC) and compliance with the Bank Secrecy Act and applicable anti-money laundering (AML) regulations;
- Not be located in, or a resident of, any country or region subject to comprehensive US sanctions, and not appear on any US Treasury OFAC sanctions list or equivalent watchlist; and
- Use the Services only for lawful personal remittance purposes, not on behalf of a business or for commercial payment processing, unless separately agreed in writing.
Beneficiaries who receive funds in India through Senda are not required to hold a Senda account but must complete any identity verification required by the receiving bank or partner in India to receive funds.
3. The Services
Senda enables you to initiate transfers of US dollars from a linked US funding source for delivery to a designated beneficiary’s bank account in India, in Indian rupees or another supported currency, subject to exchange rates, fees, and transfer limits disclosed to you at the time of each transaction.
Each transfer is processed in the following general stages, which you will be notified of via the app and/or SMS/email where you have opted in:
- Transfer initiated and request submitted for processing;
- Funds debited from your linked funding source;
- Transfer submitted to the Partner and/or its banking and payment partners for cross-border processing and currency conversion;
- Funds delivered to the beneficiary’s designated bank account.
Estimated delivery times are provided for convenience only and are not guaranteed. Delivery may be delayed due to compliance review, incorrect beneficiary information, holidays, or events outside Senda’s or the Partner’s control.
4. Fees and Exchange Rates
Senda will disclose the applicable fee and exchange rate for each transfer before you confirm it. Fees and exchange rates may vary based on transfer amount, funding method, payout method, and market conditions, and are subject to change without prior notice to reflect market rate fluctuations, except where required otherwise by applicable law (including any disclosures required under Regulation E / the Remittance Transfer Rule for consumer remittance transfers).
You authorize Senda and the Partner to debit the disclosed amount, including all applicable fees, from your linked funding source upon confirming a transfer.
5. Cancellations, Refunds, and Errors
You may cancel a transfer within the timeframe disclosed at the time of the transaction (typically before the transfer has been submitted for processing), as required under applicable remittance transfer regulations. Once funds have been submitted for cross-border processing, cancellation may not be possible.
If you believe an error occurred in connection with your transfer (incorrect amount, funds not delivered, etc.), you must notify Senda within [180] days of the date funds were promised to be available, in accordance with applicable error resolution rules. 6. Your Responsibilities
- You are solely responsible for the accuracy of beneficiary information (name, account number, IFSC/routing details) you provide. Senda is not liable for funds sent to an incorrect beneficiary due to inaccurate information you supplied.
- You must not use the Services for any unlawful purpose, including money laundering, terrorist financing, fraud, or evasion of tax or currency control laws of the United States, India, or any applicable jurisdiction.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
7. SMS, Email, and Push Communications
By opting in, you agree to receive transactional SMS, email, and/or push notifications related to your transfers (e.g., debit confirmations, transfer status, delivery confirmation). Message and data rates may apply. You may opt out of SMS at any time by replying STOP, and of other communications using the unsubscribe instructions provided in each message.
8. Compliance, Sanctions, and Reporting
Senda and the Partner are required to comply with US Bank Secrecy Act, OFAC sanctions, and applicable Indian foreign exchange and remittance regulations (including FEMA and RBI guidelines applicable to inbound remittances). Senda and/or the Partner may delay, hold, request additional information for, or decline any transfer where required for compliance purposes, and may report transactions to regulators or law enforcement as legally required.
9. Limitation of Liability
To the maximum extent permitted by law, Senda’s and the Partner’s aggregate liability arising out of or relating to the Services is limited to the amount of the transfer giving rise to the claim. Neither Senda nor the Partner is liable for indirect, incidental, special, or consequential damages, or for delays or failures caused by events outside their reasonable control, including third-party bank or payment network errors, sanctions screening holds, or force majeure events.

10. Dispute Resolution and Governing Law
